Are DOA Warranty Terms From China Suppliers Enforceable or Marketing?

When a notebook panel from a China supplier arrives dark, or the carton shows up already wrecked, the buyer needs a page both sides already signed — not a slogan on a shop badge. Dead on arrival, or DOA, is a receiving rule: the unit never worked, or transport damage stopped normal use, inside a short window after receipt. Warranty is a later clock, for a unit that worked and then failed. Storefronts print both words on one badge, so the search looks like a court question when it is a paperwork question.

A China-supplier “DOA warranty” line is a process a buyer can run only when the written confirmation names three fields: when the clock starts and how many days it runs; what file to send; and how many working days to a yes, then to a replacement, reshipment, or refund. A shop badge that only says “DOA supported” is marketing. Those three fields are not a court guarantee. They are the file both sides can open when the carton is already wrong.

Brazil-bound repair shops, importers, and notebook-parts wholesalers usually meet these clauses as a storefront sentence or a chat promise. The test that matters is narrower: can the buyer start a claim without inventing the rule after the dispute begins.

On a first bulk lot, “enforceable” means a written process

On a first bulk lot, enforceable means the buyer can open a written process: a start date, a file list, and two reply clocks that already sit on the confirmation both sides kept. It does not mean a Brazilian or Chinese court will award damages on a storefront badge. A lawsuit is a later, slower path. The planning tool is the process that can run without a court.

China and Brazil both sit on the United Nations list of CISG parties — the Convention on Contracts for the International Sale of Goods. When that convention applies, and neither side has carved it out, it can fill gaps in a sales contract. It still cannot invent a start date, a serial-number ask, or a working-day reply that the confirmation never named. “CISG applies” is not a claim file. A no-light screen still needs the three fields on the page.
